Frequently Asked Questions (FAQ)

Question: How is the termination of an employment contract formalized?

Answer: Termination of an employment contract must, in all cases, be carried out in accordance with the Labor Code of the Republic of Kazakhstan (RK LC) as follows: a copy of the order for termination of the employment contract must be provided to the employee within 3 days. If direct delivery is not possible, the notice must be sent to the employee via postal service (Article 62, Paragraph 4 of the RK LC).

Question: When an employment contract is terminated, how is the employment record book handed over to the employee, and under what circumstances can it be retained?

Answer: According to Article 63 of the RK LC, the employer is obliged to hand over the employment record book to the employee on the day the employment contract is terminated. If it is not possible to hand it over on that day, the employer must notify the employee by postal service within 10 working days to collect the employment record book.

In addition, according to Paragraph 2 of Article 24 of the Rules for Maintaining and Storing Employment Record Books, approved by the Resolution of the Government of the Republic of Kazakhstan No. 1167 dated October 14, 2011, upon termination of the employment contract, the employee signs a special register in the HR department when receiving the employment record book, as it is a personal document.

According to Paragraph 25 of the same Rules, employment record books not collected by employees upon termination of employment are stored separately in the organization’s HR department for two years. After this period, unclaimed employment record books are stored in the organization’s archive for fifty years, after which the employer must destroy them.
